Real Estate Agents & Channel Partners
Agents are part of the chain regulated by the RERA Act, 2016. Section 9 requires registration of real estate agents before they facilitate sales in projects the Act covers, and Section 10 sets out their duties. NXS48 - The RERA Specialists supports individual brokers and firms with registration, renewal and advertising compliance, backed by a team of 200+ professionals across employees and associates.
Overview
- Real estate agents
The four services in this category are practical ones: registering and renewing without a lapse, finding out whether training or certification applies in a state, getting brokerage and channel-partner agreements right, and checking advertisements for the information the law expects. Each is useful on its own; together they keep an agency’s paperwork current.
Which disciplines are involved
Advocates handle registration, agreements and disputes. Chartered Accountants assist with entity documents, tax identifiers and commission records.
The scope and responsible professional are identified in the engagement. Professional certificates are signed in the relevant professional or firm's own name. NXS48 is not an examination or certifying body.
How should an agency organise its regulatory records?
Identify the person or entity carrying on the covered agency activity and the state in which the project is located. Section 9 registration is not a transferable national licence for every connected business. The applicant’s name, constitution, signatory and operating records should agree, and the validity of the registration should be monitored separately from a developer appointment.
In Maharashtra, competency requirements need attention alongside registration and renewal. Order 52/2024 addresses the specified categories of persons and the consequences of missing competency evidence. Training enrolment, passing an examination, obtaining a certificate and holding a valid registration are different milestones. A firm should not assume one employee’s record answers every requirement for buyer-facing staff.
Maintain a register of registrations, validity, competency evidence, authorised signatories and update applications. Check whether any registration is lapsed, in abeyance or revoked and why. A submitted renewal is not necessarily a granted renewal. Availability of training support through NXS48 remains unconfirmed, and no accreditation, examination role or ability to issue certificates is claimed.

How do project checks and advertising controls work together?
Before promoting a listing, match the unit, building and phase to the official registration and developer authority. A familiar project name may cover several phases with different permissions and dates. Section 10 sets agent duties, including duties concerning unregistered covered projects and unfair trade practices. Do not treat the developer’s instruction as a complete answer to the agent’s own responsibility.
Review both the facts claimed and the required identifiers. Section 11(2) concerns promoter advertisement information, while Maharashtra’s agent rules and Order 46C/2025 add relevant identifier and layout requirements. The order addresses font comparison, visibility, top-right placement and a readable QR code maintaining aspect ratio. Check the final printed or digital output, because design-file compliance can be lost through cropping or compression.
Keep an asset register showing version, project number, verification date and approval. Withdraw outdated material when project particulars or status change. Agent-created brochures and social posts should not be assumed to inherit approval from a developer’s separate campaign. If a notice arrives, preserve the published material and obtain advice on the actual allegation and response rather than simply deleting the evidence.
How can brokerage documentation prevent avoidable disputes?
The channel-partner agreement should identify the service, accepted-lead process, commission trigger, payment timing, taxes, cancellation treatment and termination effect. A percentage without a defined trigger leaves important questions unanswered. Booking, agreement registration and customer payment are different events. Preserve the policy or schedule incorporated into the appointment, including later changes.
Maintain lead-by-lead evidence connecting introduction, acknowledgment, customer transaction and the contractual milestone. A shared customer name alone may not establish entitlement where several agents were involved. Periodic reconciliations and written confirmations help identify disputes before memories and records diverge. Staff should know who can approve an exception and what documentation is needed.
If commission is disputed, assess the agreement and available forum rather than assume every dispute belongs before RERA. Negotiation, a reasoned notice, arbitration or another route may need consideration. A settlement should state the leads covered, payment obligation and releases. The services below separate regulatory filing, potential training support, agreements and advertising review. No pass, registration, commission recovery or dispute outcome is promised, and regulated work requires the named professional’s engagement.

Agent Registration & Renewal
Application and renewal coordination for individuals or entities, subject to the requirements of the relevant state portal.
Identify whether the applicant is an individual or an entity and which persons are authorised to act for it. The business name, constitution documents, PAN and signatory authority should agree. Section 9 concerns agents facilitating the covered sales; a registration belonging to one person should not be treated as a licence that every unrelated firm or associate can use.

Read the service pageAgent Registration, Training & Exam Preparation
Support with registration applications and training or exam preparation. NXS48 is not an examination or certifying body.
Training coordination may involve explaining the official process, checking applicant records and tracking completion evidence. It is not the same as operating an accredited training institute, administering an examination or issuing a competency certificate. NXS48’s offering in this area remains unconfirmed, and this page does not claim accreditation or authority to certify agents.

Read the service pageBrokerage & Channel Partner Agreements; Commission Dispute Resolution
Review and dispute support for brokerage and channel-partner arrangements within an agreed scope.
A brokerage agreement should identify the parties, project, services, lead-registration process and event that earns commission. Booking, agreement registration, customer payment and possession are different events; the contract should not leave the trigger implicit. Clarify whether the agent is exclusive, whether developer approval is needed for a lead and how competing introductions are resolved.

Review support for real estate advertisements and required project or agent identifiers, subject to current requirements.
Section 11(2) requires the promoter’s advertisements or prospectus to prominently mention the Authority website and project registration number. Maharashtra Rule 14(2), as recited in Order 46C/2025, concerns quotation of agent and project registration numbers in agent advertisements. The audit should identify the advertiser, exact registered phase and medium before applying the checklist.
