Section 56: who can represent you before RERA?
The specified representation categories, written authority and the limits of forum-specific permission.
Who does Section 56 permit to appear?
Section 56 allows the specified applicant or appellant to appear personally or authorise one or more chartered accountants, company secretaries, cost accountants, legal practitioners or its officers to present the case before the Authority, adjudicating officer or Appellate Tribunal, as applicable. The statutory categories and the actual representative’s qualification should both be checked.
This is not permission for any consultant to appear. A business affiliation or founder title does not replace the required qualification and authority. No professional is described as having reviewed this website merely because their biography appears elsewhere.
What should a client confirm before giving authority?
Confirm the forum, professional identity, scope, authority document, communication responsibilities and whether filing, hearings, settlement, appeal or execution is included. The client should approve material facts and understand who can accept instructions. Section 56 is forum-specific and does not by itself confer a right of audience in every court or insolvency proceeding.
Keep the signed authorisation and case records. Agree who monitors directions and sends orders promptly, because a missed deadline can affect rights even where a representative has been appointed.
