Legal and technical support for housing societies

Redevelopment documentation, developer due diligence and conveyance support for societies.

Last reviewed 2026-10-24

A housing society deciding on redevelopment is making a decision for every member at once. The documents involved, a development agreement, individual permanent alternate accommodation agreements and a power of attorney, bind the society and its members for years, and a gap in any one of them tends to surface when the project is already under way.

NXS48 supports societies with document review and drafting by advocates, financial review by Chartered Accountants, and technical review by engineers and architects of areas, plans and approvals. We do not select a developer for a society; we help the managing committee and members understand what they are being asked to sign.

Situations we are asked about

  • Evaluating bids from developers for redevelopment
  • Reviewing a draft development agreement before the general body votes
  • Understanding what a PAAA should record about carpet area, transit rent and possession
  • Pursuing conveyance where the society’s title has not been conveyed to it
  • Checking RERA registration of a redevelopment project that includes sale of free-sale units

Legal touchpoints

  • Maharashtra Co-operative Societies Act, 1960 and the society’s bye-laws
  • Maharashtra Ownership Flats Act, 1963 (conveyance provisions)
  • RERA Act, 2016 for the sale component of a redevelopment project
  • Registration Act, 1908 and the Maharashtra Stamp Act, 1958 for execution formalities

Frequently asked questions

Does a redevelopment project need RERA registration?

A project that includes the sale of units to buyers generally falls within the registration requirement in Section 3, subject to its exemptions. Whether a specific project is covered depends on its facts and should be confirmed by a case-specific review.

Can NXS48 choose a developer for the society?

No. The choice belongs to the society’s members. NXS48 can review the bids, agreements and developer information the society places before it and explain legal and financial implications.
