What this service involves

Section 9 requires a real estate agent to be registered with the state authority before facilitating the sale or purchase of units in a project covered by the Act. Registration can be for an individual or for a firm or company, and the rules specify documents and a validity period after which renewal is needed.

Support covers identifying the right category, preparing documents, filing and tracking, and renewing on time. Lapsed registration is a common problem for agents who have been busy.

Who needs to be identified in the application?

Identify whether the applicant is an individual or an entity and which persons are authorised to act for it. The business name, constitution documents, PAN and signatory authority should agree. Section 9 concerns agents facilitating the covered sales; a registration belonging to one person should not be treated as a licence that every unrelated firm or associate can use.

The application should follow the current state portal and rules. In Maharashtra, competency requirements must be checked alongside registration requirements. Order 52/2024 addresses the certificate of competency, including the identified signatories and buyer-facing personnel. Completion of training, possession of a certificate and a valid registration are related but distinct statuses that should not be conflated.

How should renewal and status be monitored?

Record the certificate’s validity and the current renewal instructions before expiry. Order 52/2024 recites Rule 13(1), under which renewal applications are made at least sixty days before expiry. Check the current process and any subsequent directions for the actual application. Starting document collection shortly before expiry may leave insufficient time to address deficiencies.

Check whether the registration is valid, lapsed, in abeyance or revoked and why. A competency certificate does not automatically restore a registration affected by another issue. Preserve submission acknowledgments and the final decision. If the business changes constitution, signatory or address, obtain advice on the appropriate update rather than assuming an old certificate remains accurate for the new arrangement.

What duties continue after registration?

Section 10 includes duties concerning covered unregistered projects, records, unfair trade practices and access to information. The agent should verify the project and phase being advertised rather than rely only on the developer’s brand. The registration number and required project identifiers need to be used correctly in advertisements and transaction material under the applicable rules and directions.

Maintain a compliance file containing registration, competency evidence, developer authorisations, brokerage agreements, listing checks and complaint correspondence. Train staff on escalation when a project number, approval or sales claim cannot be verified. Registration is not an endorsement of every project sold by the agent and does not promise commission recovery. The scope of support should identify filing coordination separately from legal advice on disputes.

Practical decision points

An entity may have a current registration while a changed authorised signatory or buyer-facing staff record has not been reviewed for competency compliance. The application checklist should identify the actual persons and current official requirements, not only the firm name. The file should show which evidence was supplied and which update remains outstanding.

For renewal, record the expiry date, internal preparation date and official application requirement separately. If the portal status indicates abeyance or revocation, examine the reason before selecting a renewal route. Uploading a competency certificate may not resolve every independent defect or revive an already expired registration.

The final handover should include the submitted application, supporting records, acknowledgment, Authority response and current certificate or status. The agency should know when the next action is due and who monitors it. Any advertised registration number should be checked against that actual status. Filing coordination does not certify that every listing, staff activity or commission arrangement of the agency complies with law; those may need separate review.
