Sections 9 and 10: agent registration and continuing duties

When does an agent need registration?

Section 9 requires registration before an agent facilitates the covered sale or purchase in a registered real estate project being sold by the promoter. Identify the person or entity conducting the activity and the relevant state requirements. An associated firm’s registration should not be assumed to cover a different applicant or business.

Collect constitution, identity, address and signatory records. Check current validity, renewal instructions and any abeyance or revocation status. Maharashtra Order 52/2024 addresses competency certificates and specified categories of persons; training completion is not itself a substitute for valid registration.

What continues after the certificate is issued?

Section 10 includes duties concerning unregistered covered projects, records, unfair trade practices and information for buyers. Agents should verify the phase and registration used in listings, preserve appointment and commission records, and check advertisements against current requirements. A certificate is not an endorsement of every project or an assurance of commission payment.

Order 46C/2025 addresses project identifiers, QR code, font and placement in Maharashtra advertisements. Review final artwork, not just a design template. For renewal, verify the current Rule 13 process and official instructions rather than waiting until expiry.
