Section 12: misleading advertisements and QR compliance
Substantive advertising responsibility and Maharashtra identifier, font and QR requirements.
What does Section 12 address?
Section 12 concerns loss or damage caused by an incorrect or false statement in an advertisement, prospectus or model in the statutory circumstances. Preserve the representation, date, payment and evidence of reliance. Not every disagreement about a brochure produces the same remedy, and advertising compliance requires more than displaying a registration number.
Check claims about approvals, area, amenities and completion against the actual project record. A registration must not be presented as government assurance of title or future performance. Outcomes depend on facts and the decision of the Authority or Tribunal.
What does Maharashtra require in advertisement layout?
Order 46C/2025 requires the project registration number and Authority website address to meet its font comparison and top-right placement rules, with visible colour. It also requires a readable, detectable QR code, maintaining aspect ratio, in that quadrant. Check the final published format because cropping and compression can defeat an otherwise compliant design.
The order applies to the described promoter and agent advertisements across media. Read it with Section 11(2), agent duties and the applicable rules. Agent-created versions should be checked separately; one approved template does not validate every later campaign.
