What this service involves

Section 44 provides the appeal route from the Authority or adjudicating officer to the Appellate Tribunal. Section 43(5) imposes a promoter pre-deposit condition. Section 58 provides the specified High Court appeal route; Article 226 and insolvency proceedings are distinct questions requiring separate maintainability and forum analysis.

Appeal strategy begins with the order: its reasoning, the grounds on which it can be challenged and the limitation period. Advocates draft the memorandum of appeal and prepare for hearing. Results depend on the matter and the forum.

How is the appellate route and deadline identified?

Section 44 provides an appeal to the Appellate Tribunal within sixty days from receipt of the relevant direction, decision or order, with a sufficient-cause provision for delay. Record receipt evidence immediately and obtain advice on computation. The appeal needs a reasoned challenge to the order, the record below and precise relief; it is not simply a fresh complaint with the same allegations.

In Maharashtra, verify the current MREAT filing instructions, documents, service requirements and applicable rules. A statutory disposal period is not a promised hearing date. Where interim protection is needed, prepare a separate reasoned request and explain the effect of the order while it remains unstayed. Filing an appeal alone should not be represented as suspending compliance.

What does promoter pre-deposit mean?

Section 43(5) imposes a condition before a promoter’s appeal is entertained: at least thirty per cent of the penalty or a higher percentage determined by the Tribunal, or the total amount payable to the allottee including interest and compensation, or both, as applicable. It is not a universal thirty-per-cent deposit of every award and not a rule for every appellant.

Review the exact operative directions and the appellant’s status before calculating the requirement. The financial and litigation teams should agree the amount, evidence and procedural treatment. A request for relief from an adverse order must be distinguished from satisfaction of the statutory precondition. This draft does not assert that a deposit can be waived or replaced by a particular security.

When do High Court or insolvency questions arise?

Section 58 concerns appeal from the Tribunal to the High Court on the grounds specified through Section 100 of the Code of Civil Procedure, subject to the statutory period and proviso. Article 226 is a distinct constitutional jurisdiction, not an automatic substitute for the appellate route. An advocate must assess maintainability, alternative remedies and the actual issue before recommending court proceedings.

Builder insolvency or NCLT proceedings require a separate IBC analysis, including any moratorium and the client’s position in that process. RERA representation does not itself confer a right to appear in every other forum. The engagement must identify the advocate and forum-specific scope. Outcomes depend on facts and the decision of the Authority or Tribunal; no stay, admission or appellate result is promised.

Practical decision points

If the challenged order contains both a penalty and a payment direction to an allottee, separate those components before analysing Section 43(5). A single percentage applied to the combined figure may misstate the pre-deposit condition. The appeal team and finance team should use the same operative order and identify the legal basis of their calculation.

Prepare grounds that identify the finding challenged, relevant record and alleged legal or factual error. New evidence or an issue not raised below may require procedural advice. A long chronology without a reasoned challenge does not by itself explain why the order should be changed.

For a later High Court question, distinguish the statutory Section 58 route from constitutional jurisdiction and obtain advice about maintainability. The authority to represent under Section 56 does not itself establish rights of audience in every court. The client should receive a forum-specific engagement, deadline assessment and evidence list rather than a general promise to pursue every available proceeding.

Frequently asked questions

What is the pre-deposit?

For a promoter appeal, Section 43(5) concerns at least thirty per cent of the penalty or a higher percentage determined by the Tribunal, the total amount payable to the allottee including interest and compensation, or both as applicable. It is not thirty per cent of every award.

Can I go straight to the High Court?

Section 58 and Article 226 involve different routes and conditions. Maintainability and alternative remedies require case-specific legal advice.
