What this service involves

A buyer pays for carpet area, defined in the Act, and sometimes receives less. Agreements can also contain terms that favour the promoter heavily, such as one-sided cancellation, forfeiture or variation clauses. The Act and state rules set a framework, including a model form of agreement, against which terms can be compared.

Architects measure and compare against sanctioned plans; advocates compare the clauses with the Act and rules and advise on remedies. A shortfall in area has to be shown by measurement and not only by recollection.

How is an area difference established?

Begin with the statutory definition in Section 2(k), the agreement area schedule and the sanctioned plan. Carpet area excludes external walls, service shafts, exclusive balcony or verandah and exclusive open terrace, while including internal partition walls. A measurement using another convention should not be compared directly without reconciliation. Ask the technical professional to identify the method and drawing used.

Separate a plan discrepancy from a physical measurement discrepancy and from a pricing or refund clause. The agreement may refer to several area descriptions, and sales material may use additional terminology. Prepare a table showing each representation, its source and its legal or contractual significance. Do not assume that a difference in a brochure alone proves the delivered unit is deficient.

How are disputed clauses reviewed?

Read clauses together, including payment defaults, cancellation, possession, variation, dispute resolution and limitations on remedies. A clause described as standard can still require examination against mandatory law. The advocate should identify the precise objection and applicable provision rather than label the entire agreement unfair without analysis. Section 13 concerns the agreement and advance-payment restriction; Sections 14 and 18 address different obligations and remedies.

For an unsigned draft, the output may be a negotiation note. For an executed agreement, the question becomes how the clause is interpreted or challenged and what relief is available in the appropriate forum. The client should understand the difference between proposing better drafting and obtaining an order that affects an existing contract. Preserve the version actually signed and every incorporated schedule.

What does an evidence-led dispute pack include?

Collect the agreement, allotment letter, payment trail, representations relied on, approved plans, measurement report and relevant correspondence. The chronology should show when the buyer learned of the difference and what explanation was requested. If a revised plan or area statement exists, identify who approved it and whether applicable consent requirements were addressed.

Any calculation should state the area basis, contract term, rate assumption and adjustment sought without presenting an estimate as an awarded sum. Settlement should identify the exact variation or payment accepted and the claims released. Outcomes depend on facts and the decision of the Authority or Tribunal. The service does not promise that a clause will be struck down or that a particular area adjustment will be ordered.

Practical decision points

Suppose a buyer compares a physical usable-area measurement with the agreement’s statutory carpet figure and finds a difference. Ask the architect to reconcile the measurement convention, internal walls and separately described balcony or terrace before alleging a shortfall. The dispute should be based on comparable figures and the actual agreement, not two numbers using different definitions.

If a clause allows variations, identify its scope and assess it against Section 14 and the facts. A signed clause is not automatically decisive of every statutory question, but it should not be ignored. The advocate should explain the challenge and available relief precisely.

The case pack should preserve plans, measurement notes, agreement schedules and the communications in which the buyer raised the issue. Any settlement should identify the accepted area basis or contractual amendment and the claims released. A generic satisfaction letter can have wider consequences than the buyer intends, so its wording deserves separate review.
