Developer & Promoter Turnkey Compliance
Real Estate Tax & GST Advisory for Developers (CA)
Chartered-accountant-led tax and GST review for real estate development matters.
What this service involves
Real estate developers face income tax and GST questions on revenue recognition, joint development, transfer of development rights, input credit and compliance. The rules change often and can differ between projects depending on their approvals and the date of commencement.
A Chartered Accountant reviews the project’s structure, identifies the provisions that apply and prepares a written view. Compliance work such as returns is agreed separately.
How is the project’s tax fact pattern established?
The CA should map the promoter entities, project type, land acquisition structure, development agreements, customer contracts and timing of supplies. Residential, commercial and mixed arrangements may raise different issues, and a project’s RERA registration does not itself determine its GST treatment. The applicable tax period and effective law must be identified before any rate or credit conclusion is given.
Collect customer receipts, invoices, cancellation records, land and contractor agreements, completion or occupancy material and prior returns. A tax review should explain whether it is testing historical compliance, advising a proposed transaction or supporting recurring filings. Those scopes require different evidence and may involve different remediation work. This site does not publish a blanket rate, exemption or input-credit entitlement.
Why do commercial terms and account controls matter?
Agreement clauses should state the treatment of taxes, changes in law, deductions, credit notes and cancellation adjustments without conflicting with statutory liability. A contract can allocate an economic burden but cannot necessarily change the person legally responsible to the tax authority. Sales teams should use the same assumptions as finance so buyer demands do not describe a tax treatment the CA has not approved.
Reconcile tax records with project books and bank flows while preserving the distinct purpose of the RERA accounts. Tax compliance does not establish compliance with Section 4 account restrictions, and a RERA withdrawal certificate is not a GST return. Differences between invoice value, receipts and reported sales should be explained, not forced into equality where timing or classification legitimately differs.
What should the professional advice deliver?
A written note should identify facts, law and notifications relied on, effective dates, assumptions, conclusions and actions. For historical transactions, the review should use the legislation applicable to those events; for future transactions, it should identify changes requiring re-evaluation. A legislative transition or amended notification is a reason for a fresh check, not for reusing an old project memo.
The action schedule may include document changes, reconciliations, return corrections or a request for specialist advice. Representation, litigation, valuation and statutory audit are separate unless expressly included. The named CA must review the evidence and confirm responsibility for regulated advice. No tax saving, refund or assessment outcome is promised by this page, and professional sign-off remains pending.
Practical decision points
If customer cancellation records in the sales system do not match credit notes or return workings, the CA should reconcile the transaction dates, documents and treatment before advising a correction. A difference may be timing, classification or error; it should not be eliminated with an unexplained journal entry.
Where a developer changes the landowner arrangement, consider whether the earlier tax memo still describes the actual supplies and consideration. The revised legal documents and commercial model should be reviewed together. A tax conclusion for one project category or period should not be copied into another project merely because the promoter is the same.
The final note should list the records reviewed, applicable period, effective provisions and proposed actions, with responsibility for each filing or document change. Any unresolved technical interpretation should remain visible. The engagement should distinguish advisory work from return preparation, assessment representation and audit, and should identify the CA who accepts responsibility for the regulated output.
