Land Aggregation & Title Clearance
Title-document review and transaction coordination for land aggregation, subject to matter-specific scope.
What this service involves
Assembling a large site from many small parcels multiplies title work: every parcel has its own chain, and every holder, tenant or occupant has to be accounted for. A defect in one parcel can affect the whole project.
We build a parcel register, run title review on each parcel and flag those that need rectification, such as heirs not joined, mutation gaps or encroachments. Where occupants need to be settled, advocates advise on the documentation of settlement.
Why does each parcel need its own risk record?
Aggregation joins transactions, not just map shapes. Each parcel can have a different owner, title history, tenure, access, mortgage and occupation pattern. Create a parcel register before negotiations advance, linking survey identifiers to deeds, revenue extracts, measured area and proposed consideration. A clean file for one owner should not be used to describe the entire assembled site as cleared.
Identify dependencies between parcels. A small strip may provide the only lawful access; a disputed portion may be needed for setbacks or a contiguous layout. The commercial agreement should explain what happens if a key parcel cannot be acquired. Sequencing matters because completing some purchases may expose the buyer to holding land that cannot support the intended scheme without the remaining owners.
How are occupants, tenants and family claims assessed?
Prepare an occupancy schedule independently of the ownership schedule. A person living or operating on the land may claim tenancy, licence, inheritance, possession or another interest. The advocate should identify the asserted basis and the evidence, not assume every occupant can be removed by a seller undertaking. Settlement authority and applicable protections require case-specific advice.
Any proposed settlement should identify the parties, interest being addressed, consideration or accommodation obligations, possession handover and release documentation. Confirm who can bind a family, entity or group and whether additional approvals are required. Coercion, informal cash arrangements and incomplete releases create risks that a later title report may not cure. The scope is lawful advisory and documentation, not a promise of vacant possession.
How are title conditions closed across the assembled site?
Use a common completion matrix while retaining parcel-specific conditions. Track mortgage releases, succession evidence, boundary clarification, permission conditions and instrument execution separately. Each closure should refer to the actual evidence obtained. Describing a file as under process is not the same as satisfying a condition. The client should see which parcels are ready, conditional, disputed or excluded.
Before final consolidation or development documentation, reconcile the aggregate land schedule with individual instruments and survey material. Check that access and common rights are preserved and that unacquired strips are not included in the proposed project area. Planning, tax, stamp and RERA questions may change as the assembly evolves. A title-clearance engagement should state its cut-off date and should not imply that future objections or statutory approvals have been eliminated.
Practical decision points
Access and contiguity should be assessed by legal right as well as physical appearance. If a road crosses a parcel not being acquired, identify the supporting easement, permission or other basis and its limits. Do not assume that long use alone answers the legal question without case-specific examination.
Suppose most parcels are ready to transfer but the only access parcel has an unresolved inheritance claim. The aggregation report should identify that dependency as a site-level issue rather than describe the assembly as substantially cleared based on area alone. The buyer should understand the consequence of completing other purchases first and the options for sequencing or conditional completion.
Each parcel’s unresolved items should retain their own owner, document source and closure evidence. If an occupant settlement is proposed, record the rights asserted and authority of the persons signing. A general receipt from one representative should not be assumed to release every independent interest on the land.
Who needs it
Developers and landowners assembling land, and lenders or investors funding aggregation.
Documents usually required
- List of parcels with survey or CTS numbers
- Title documents and records for each parcel
- Agreements already signed with holders
- Occupant and tenancy details
- Layout or concept plan for the aggregate
Step-by-step process
- Create the parcel register
- Run title review parcel by parcel
- Reconcile boundaries against survey records
- List defects and rectification steps
- Review settlement documents for occupants
- Report on readiness of the aggregate
Typical timeline
The time depends on the number of parcels and how many need rectification. Timing depends on the matter, document readiness and the relevant authority process; confirm the scope and timeline before engagement.
Delivered by

Frequently asked questions
Can parcels be cleared independently?
Often yes, but the aggregate needs to be read as a whole for access and boundary.
Does this include negotiating with owners?
We review and draft documents; commercial negotiation stays with the client.
