Society redevelopment: DA, PAAA and the first member decisions

How title, tender assumptions, member decisions and individual accommodation terms fit together.

What should be settled before selecting a developer?

Establish the society’s title and conveyance position, member records, existing areas and applicable planning framework before comparing offers. Use common assumptions for technical potential, rent, corpus, security and timing. The committee and advisers organise the information, but members decide through the applicable society process, which requires case-specific legal verification.

Retain notices, minutes, questions and the bid comparison. Separate unconditional commitments from benefits dependent on extra FSI or future approvals. Do not publish a universal voting rule without checking the society type, governing law and current directions.

How do the DA and PAAA protect different interests?

The development agreement records the society-level bargain, while the PAAA records the individual member’s replacement accommodation and related rights. Both must agree on area, possession, transit rent, security and variation mechanisms. A favourable clause in one document can be weakened by an inconsistent schedule or broad power of attorney elsewhere.

Compare the final documents with the approved bid and resolutions before execution. Check registration applicability: Section 3(2)(c) does not create a blanket exemption for redevelopment containing marketing or sale. Track rent, security renewals and approvals after signing; document review does not assure construction.
