What does deemed conveyance address?

Section 11 of the Maharashtra Ownership Flats Act provides the relevant conveyance framework where the promoter has not completed the required transfer. A society needs its agreements, land records and layout examined to establish the interest and property concerned. Filing an application is not the same as obtaining a completed registered conveyance.

Identify the competent authority and current procedure. Collect the society registration, purchaser agreements, title records, approved layout, correspondence seeking conveyance and relevant promoter details. This is not primarily a RERA registration process, and a RERA number does not cure missing society conveyance.

Why can the property schedule be contentious?

Several buildings, common amenities, phased development, leasehold interests or competing claims can make the conveyance extent difficult to define. The society’s occupied boundary may differ from the land promised in agreements. Legal and technical reconciliation is needed before describing the whole layout as belonging to one society.

Track the stages after any order: the appropriate instrument, stamping or adjudication, registration and record updates as applicable. Keep the final schedules and plans with the registered document. Deemed conveyance does not automatically obtain redevelopment permission or determine every disputed title claim.
