Section 7: revocation of project registration

Grounds, notice, possible conditions and what revocation means for remaining development.

NXS48 editorial · Owner-approved for publicationLast reviewed 2026-10-24

When can the Authority consider revocation?

Section 7 identifies grounds including statutory default, violation of approval conditions, unfair practices or irregularities and fraudulent practices. Section 7(2) requires at least thirty days’ written notice of the proposed grounds and consideration of the response. A notice is serious, but it is not itself the final revocation decision.

The response should address each ground with records and any lawful remediation. Section 7(3) permits continuation subject to further conditions instead of revocation, but that is an Authority decision, not an entitlement promised by an adviser.

What follows revocation for buyers and promoters?

Section 7 provides consequences including project-page restrictions, defaulter information and bank-account directions. Section 8 addresses facilitation of remaining development and the specified association right of first refusal in a revocation context. Those provisions do not automatically give an association finance, title or permission to build without further legal and technical steps.

Check the actual order, appeal position, existing finance and any insolvency proceedings before proposing a takeover strategy. Outcomes depend on facts and the decision of the Authority or Tribunal. Avoid treating an allegation, notice and final operative order as identical statuses.
