Section 6: registration extension and force majeure
The statutory extension routes, evidence of causation and the distinction from contractual possession rights.
Does every project delay qualify for extension?
No. Section 6 contains a defined force-majeure explanation and a proviso concerning reasonable circumstances without promoter default, with recorded reasons and an aggregate limit of one year under that proviso. The application must identify the actual legal basis, affected activities and supporting evidence rather than assume that any difficult circumstance qualifies.
Build a chronology connecting the event to the work programme. Include progress, remaining approvals, funding, mitigation and the period sought. Where relying on a separate Authority direction, verify its project and date applicability.
Does extension erase an allottee’s delay claim?
Registration validity and contractual possession obligations are different questions. An extension should not be represented as automatically rewriting an agreement or extinguishing a Section 18 claim. The actual order, agreement, facts and current law need assessment. A pending application also does not mean the project has already received an extended registration.
Continue applicable disclosures and track any conditions imposed. If the period expires or an application is refused, obtain prompt advice about permissible activity and remedies. Outcomes depend on facts and the decision of the Authority or Tribunal.
