## Quick answers

What is it?

Support preparing an extension matter and associated records; legal position and eligibility require case-specific review.

Who needs it?

Promoters whose project may not complete within the registered period.

How long does it take?

Depends on the Authority’s process and on the evidence available.

## What this service involves

Section 6 addresses extension for force majeure and includes a proviso for reasonable circumstances without promoter default, on recorded reasons, with an aggregate one-year limit under that proviso. The legal basis, cause, evidence and period sought must be examined separately; not every delay qualifies.

The application needs a clear account of the delay, supported by documents. Engineers and architects document the progress and cause; Chartered Accountants prepare the financial position; advocates frame the application and deal with objections, including from allottees.

## How is the legal basis for extension selected?

Section 6 addresses extension of registration and contains a defined force-majeure explanation. It also permits extension in reasonable circumstances without promoter default, on recorded reasons, for an aggregate period not exceeding one year under its proviso. Those routes should not be collapsed into a general rule that every delay beyond the promoter’s control qualifies. The application needs to identify the actual statutory and current regulatory basis relied on.

Prepare a dated chronology connecting the event to affected activities. A general reference to difficult market conditions or an authority delay does not show how the registered completion programme was affected. Explain mitigation, work completed, work remaining and the period sought. Technical evidence and legal framing should be consistent, and any separate Authority direction should be cited by its actual applicability and date.

## What should the progress and funding evidence explain?

The Authority and allottees need a realistic account of the remaining project, not merely a revised date. The evidence should address approvals, construction stages, contractors, funding and the plan to complete. If a missing approval affects only part of the scheme, explain that distinction. If progress figures differ from earlier QPRs, reconcile them rather than silently substituting a new narrative.

Check whether there are outstanding notices, defaults, complaints or bank-account restrictions. An extension application does not automatically suspend those matters. Maintain the current compliance calendar while the application is pending, and obtain advice about what activity is permissible if the registered period expires. Do not advertise an applied-for extension as granted.

## Does extension change the buyer’s agreement rights?

Registration validity and the contractual possession date are related but distinct. A registration extension should not be represented as automatically cancelling an allottee’s Section 18 claim or rewriting the agreement. The effect of the actual order, facts and applicable law requires case-specific analysis. Communications to allottees should distinguish regulatory status from proposed contractual changes.

After a decision, retain the order, update authorised disclosures and communicate the conditions to finance, sales and site teams. Track any continuing milestones imposed. If the application is refused or only partly allowed, assess the available procedural steps promptly. Preparation can improve the evidentiary record, but the Authority decides the application and no extension duration or outcome is promised.

## Practical decision points

An application may refer to an external event affecting only one construction activity. The evidence should show when that activity stopped, why it affected the critical programme, what mitigation was possible and how the requested period was calculated. A collection of news reports about a broad event does not by itself establish the project-specific delay.

Keep the original programme, progress records, approval correspondence and revised completion plan together. If the legal basis is the reasonable-circumstances proviso rather than the defined force-majeure route, state that distinction and the relevant limits. Do not present a preferred commercial completion date as the statutory period the Authority must grant.

The client communication should explain what remains pending, what activity requires advice while registration status is uncertain and what buyer-related questions remain separate. After the decision, update the compliance calendar using the actual order and conditions, not the period originally requested.

## Who needs it

Promoters whose project may not complete within the registered period.

## Documents usually required

- Registration certificate and last approved timeline
- Progress certificate and site photographs
- Documents evidencing the cause of delay
- Financial position and fund status
- Allottee correspondence where relevant

## Step-by-step process

1. Assess whether the facts fall under Section 6
2. Compile evidence of the cause and period
3. Prepare progress and financial statements
4. Draft and file the application
5. Respond to objections and attend hearings
6. Update the portal after the decision

## Typical timeline

Depends on the Authority’s process and on the evidence available. Timing depends on the matter, document readiness and the relevant authority process; confirm the scope and timeline before engagement.

## Frequently asked questions
